Introduction.

Destinfinit offers the use of its online, offline, free or paid information tools or services to the User (you) under the conditions stated herein. By using the online or offline information tools or services provided by Destinfinit, the User agrees to all of these Terms of Use. If the User does not agree to these terms and conditions, he/she shall not be entitled to use the online or offline information tools or services provided by Destinfinit.

Destinfinit is a provider of free and/or paid information to Users from all over the world, interested in knowing about places, products or services offered by natural or legal persons called Offeror (for example, but not limited to, tour operator, airline, hotel, etc.), which are directly offering the product or service to the User and are independent from Destinfinit. In the event that the User acquires any product or service, he/she understands that he/she is buying it directly from the Offeror and it is the responsibility of the User to carry out the verifications and take the necessary precautions to complete safely any transaction he/she decides to carry out with the Offeror. Destinfinit is not responsible for the accuracy or updating of the information offered in its online or offline media, and it is the responsibility of the User to verify or not such information for use. Destinfinit acts solely as a means of contact between the User and the Offeror and has no liability whatsoever prior to, during or after any information, commercial, service or product transaction offered by the Offeror to the User.

The User declares that he/she is of legal age or that he/she has the supervision of an adult legally responsible for the User and that he/she understands the Terms of Use set forth herein. The User is responsible for treating passwords or any other sensitive personal information provided to him/her in a confidential manner and for properly guarding them, or any other sensitive personal information provided to him/her, or that he/she provides to access the online or offline information tools or services provided by Destinfinit, avoiding access to them by unauthorized third parties. The User accepts responsibility for the economic consequences derived from any use of the online or offline information tools or services provided by Destinfinit that occur through the use of their password, as well as for the use of passwords or information of the User by third parties.

The User also declares that all the information provided by him/her for access to the online or offline information tools or services provided by Destinfinit, and in the course of using them, is true, complete and accurate and undertakes to keep it updated.

The online or offline tools or services or information provided by Destinfinit are solely and exclusively for the User's own use. It is prohibited to modify, reproduce, duplicate, copy, distribute, sell, resell, or otherwise exploit them for commercial or non-commercial purposes. The User undertakes not to use these information tools or services for illegal or prohibited purposes. In particular, the User who uses the information and tools or services provided by Destinfinit accepts that he or she will only use them for his or her own private use and that the products or services offered or acquired through their use are those for which he or she is authorized to act as a User.

Limitation of liability.

Destinfinit offers information and information tools or services online or offline in the state in which they are presented, and may contain inaccuracies or errors. Destinfinit makes no representations or warranties of any kind, either express or implied, as to the information and performance of its online or offline information tools or services or the content, software, materials or products contained therein to the extent permitted by applicable law. Destinfinit disclaims all warranties, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Destinfinit will not be liable for any damages of any kind that may derive from the use of the information provided or the information tools or services, including, among others, direct and indirect damages, without prejudice to the generality of the provisions of the previous paragraph, Destinfinit does not assume any responsibility that may derive from the lack of veracity, completeness, updating and accuracy of the data or information about offers, products or services, prices, routes, distances, characteristics and any other relevant data and information about the products and services offered through these information tools by the Offerors that are the suppliers of products or services, or regarding the contents, data or information that are provided from other websites.

Furthermore, Destinfinit disclaims any liability arising from the failure or defective performance by the Offerors of products or services and/or from the obligations arising from the regulations in force and from the terms and conditions of sale of each of the products and services that are contracted through these information tools.

If, for reasons of force majeure (including, but not limited to, political, economic or unstable circumstances affecting security), there are deficiencies in the reservations, confirmations and/or execution of any product or service contracted by the User from the Offeror through the online or offline information tools provided by Destinfinit, the User understands that the Offeror is solely responsible for the claims that the customer may submit deriving from this fact and excluding Destinfinit from all responsibility, at the same time that the User renounces to present any type of claim against Destinfinit, for the said deficiencies or breaches.

The online or offline information tools provided by Destinfinit may contain links to other information sources not managed by Destinfinit. These links are included for reference purposes only. Destinfinit has no control over these sources of information and is not responsible for their content.

The inclusion of links to other sources of information does not imply that Destinfinit promotes, endorses, guarantees or recommends these contents. Links included in Destinfinit's online or offline information tools are only offered as informative references without any kind of assessment of the contents, owners, services or products offered by them.

Use of Destinfinit forums and media.

The user agrees not to engage in the following conduct while using the forums and media offered by Destinfinit:

• Defame, insult or harass other Users, or otherwise violate their legal rights.

• Publish, email or otherwise distribute defamatory, indecent or unlawful materials or information.

• Send files containing viruses or programs with similar characteristics that may affect the operation of computers, software or data, whether of Destinfinit or Users.

• Advertise or offer for sale any kind of goods or services, or conduct surveys or contests, or send messages requesting chain forwarding.

The User acknowledges that Destinfinit does not endorse, review, filter, or approve the content of chats, emails and other messages sent by other Users. Destinfinit reserves the right to deny, in its sole discretion, any User's access to its services and tools or any part thereof without notice.

Destinfinit may allow Users to submit reviews and comments on related content, services or products. If the User submits reviews or comments, the User grants Destinfinit the non-exclusive, royalty-free, perpetual, irrevocable and fully transferable right to use, reproduce, modify, adapt, publish, translate, create derivative products, distribute and display such reviews and comments worldwide and in any media. It shall also grant Destinfinit the right to use the name accompanying such review or comment, if any, in connection with such review or comment.

General information.

These Terms of Use, as well as any relationship between the User and Destinfinit shall be governed by Ecuadorian law for any dispute arising from the existence or content of these Terms of Use or the relations between the User and Destinfinit, both parties, with express waiver of any other jurisdiction that may correspond to them, submit to the jurisdiction and exclusive competence of arbitration and mediation centres of the city of Cuenca, in Ecuador.

All the contents of Destinfinit (including, but not limited to, texts, graphics, logos, button icons, images, audio files and software) are the property of Destinfinit or its content providers or as indicated in said contents, and are protected by national and international industrial and intellectual property laws. All software used in Destinfinit, or its software suppliers are protected by national and international laws of industrial and intellectual property.

Any other use of Destinfinit's content, including the reproduction, modification, distribution, transmission, subsequent location, exhibition or total or partial representation of the same, is strictly prohibited. In particular, any kind of use of Destinfinit's contents is strictly forbidden without its express consent. The above prohibitions are excluded in cases where Destinfinit offers mechanisms for the dissemination of its contents by electronic or printed means, for example, through social networking functions, among others.
